RES Terms and Services
Standard Service Duration: Services are provided on a rolling monthly basis unless otherwise agreed upon in writing. Coaching sessions, marketing strategy implementation, and consulting services will follow the schedule set in advance with the client.
Extended Services: Beyond the agreed period, additional fees may apply based on the services requested.
Coaching & Consulting Sessions: Available between 8:00 AM and 6:00 PM, Monday to Friday, with pre-scheduled times.
Availability: The Real Estate Syndicate ensures flexible scheduling, though customer presence is required for specific consulting or coaching sessions.
Missed Appointments: A fee prorated for any sessions will be charged for missed coaching or consulting appointments without prior notice. This means that there is no refunds for these services if sessions are missed.
Inclusions: Pricing covers coaching sessions, access to marketing materials, consulting services, and community engagement.
Additional Services: Custom services, such as tailored CRM reports or marketing campaigns, may incur additional fees depending on client needs and availability.
Special Requests: Additional fees may apply for unique consulting or marketing strategy requests.
Active Participation: Clients are expected to engage actively in coaching and consulting sessions to achieve desired outcomes.
Data Accuracy: Clients must ensure that all customer data provided for CRM use is accurate and up-to-date.
Non-Compliance: Clients are responsible for any business outcomes resulting from failure to implement suggested strategies or improper use of services.
CRM Services: Our services include access to a CRM (Customer Relationship Manager), which uses client-provided data to optimize business strategies and customer outreach.
Data Responsibility: Clients are responsible for ensuring the legality and proper consent of the data used within the CRM system.
Prohibited Data: Personal data that violates privacy regulations or includes sensitive information without proper consent is strictly prohibited.
Client Resources: Clients must ensure access to relevant business information, data, and staff for successful coaching and consultation sessions.
Software Access: Access to required software platforms or tools for marketing or CRM integration is the client's responsibility.
Permits & Licensing: Clients must ensure that all required permits, licensing, or authorizations related to their real estate business are in place.
Payment Due: Payments for coaching, consulting, and CRM services are due upon subscription or renewal. Additional services will be billed upon completion.
Non-payment Consequences: Failure to pay within 30 days may result in the suspension of services and collection efforts with additional fees.
Billing Adjustments: Any discrepancies must be reported within 7 days, and additional charges will be applied to the client's credit card if necessary.
Client Indemnity: Clients agree to indemnify The Real Estate Syndicate against damages or losses related to the improper use of advice, strategies, or CRM services.
Limited Liability of The Real Estate Syndicate: We disclaim liability for indirect damages or losses incurred as a result of implementing business strategies or advice.
Precedence: These terms override any previous communications or agreements unless written approval is provided by The Real Estate Syndicate.
Documentation: Clients are required to document business data shared for CRM integration purposes and provide proof where necessary.
Client Accountability: Clients are responsible for ensuring the accurate implementation of strategies provided during coaching or consulting sessions.
Adjustments Due to Market Conditions: The Real Estate Syndicate is not liable for delays or changes caused by market fluctuations, industry regulations, or external factors affecting real estate markets.
CRM Usage Guidelines: All CRM-related requests or adjustments must be coordinated through our office for proper implementation.
Communication: Any changes or requests related to services, strategies, or schedules must be communicated through the official office channels.
Client Confidentiality: All business strategies, data, and personal information shared with The Real Estate Syndicate are kept confidential and are used solely for the purpose of providing the services outlined in this agreement.
Data Security: We employ industry-standard measures to secure client data, including information used in the CRM. However, clients are responsible for safeguarding their access credentials and maintaining data accuracy.
Content Ownership: Any materials, templates, marketing strategies, or proprietary systems provided by The Real Estate Syndicate during the course of service remain the intellectual property of The Real Estate Syndicate. Clients are granted limited, non-exclusive rights to use these materials solely for their own business use.
Restrictions on Redistribution: Clients may not redistribute or sell any materials provided by The Real Estate Syndicate without written consent.
Termination by Client: Clients may terminate their services with a 30-day written notice. Early termination fees may apply based on the remaining term of service and usage of provided resources.
Termination by The Real Estate Syndicate: We reserve the right to terminate services for non-payment, misuse of services, or violation of the terms and conditions, with immediate effect.
Refunds: Refunds are available only for services that have not been rendered at the time of termination. No refunds will be given for completed services or used coaching sessions.
Performance Disclaimer: While The Real Estate Syndicate will provide the best possible advice, strategies, and tools to improve client business performance, no guarantees of specific financial results or business growth can be made.
Client Implementation: Success depends largely on the client’s implementation of strategies and advice. The Real Estate Syndicate is not responsible for missed opportunities or financial losses due to lack of action.
Right to Amend: The Real Estate Syndicate reserves the right to amend these terms and conditions at any time, with prior notice provided to clients. Continued use of services after such changes signifies acceptance of the new terms.
Notification of Changes: Clients will be notified of changes via email or the client portal at least 30 days prior to implementation of significant changes.
Dispute Resolution: Any disputes arising from the terms of this agreement will be resolved through mediation or arbitration, as agreed upon by both parties. If mediation fails, legal action may be pursued in the jurisdiction where The Real Estate Syndicate is headquartered.
Governing Law: This agreement will be governed by and construed in accordance with the laws of the state in which The Real Estate Syndicate operates.
Use of Testimonials: The client agrees that any testimonials provided regarding services may be used by The Real Estate Syndicate for marketing purposes, including social media, websites, or printed materials.
Opt-Out: Clients may opt out of this clause by submitting a written request.
Availability of Services: While The Real Estate Syndicate strives for high availability of its online services, there may be instances of scheduled maintenance or system downtimes that could impact accessibility.
Notification: Clients will be notified in advance of any planned downtime that affects CRM or coaching platform access.
Reporting Metrics: Clients will receive regular performance reports on CRM data usage, marketing campaign effectiveness, and coaching milestones. These reports help track progress and make data-driven adjustments to strategies.
Client Feedback: Feedback from clients is encouraged to improve service delivery. Clients may submit suggestions or concerns through the client portal or by contacting the office.
